In view of certain issues being raised regarding the provisions of working of patents and filing of working statements under the Patent Act, 1970, Indian Patent Office [IPO] has decided to have a consultation meeting with the stakeholders to receive feedback and further streamline procedures in this regard.
The Indian Patent Office has requested all stakeholders to submit comments on the issues related to working of patents, that is, under section 146 of the Patents Act 1970 (as amended) read with Rule 131 of Patent Rules 2003 including Form 27, and penal provisions in section 122.
The last date to submit comments is 16 March 2018 and subsequently the stakeholders meeting will be held on 21 March 2018.
As you may remember, recently Delhi High Court had observed lapses in filing of working statements and had required IPO to set guidelines to list out various steps and the timelines to put an enforcement framework in place for prosecuting errant patentees.
